AquaNature ("we," "us," or "our") respects your privacy. This Privacy Policy describes how we collect, use, share, and protect personal information when you visit aquanaturetexas.com or contact us by phone, email, or web form.
We comply with the Texas Data Privacy and Security Act (TDPSA), which took effect July 1, 2024 and applies to AquaNature's collection of personal information from Texas residents. This policy also describes the rights available to all of our customers across Texas, Louisiana, Oklahoma, and Arkansas.
Information We Collect
We collect the following categories of personal information directly from you when you contact us, request a consultation, or use our website:
- Identifiers — name, email address, phone number, mailing address.
- Project information — property address, yard size and conditions, project preferences, photos you choose to send, budget range.
- Commercial information — service history, invoice records, maintenance plan enrollment.
- Internet activity — IP address, browser type and version, pages viewed, time on site, referring URL, device identifiers, collected automatically by our website analytics tools.
We do not knowingly collect any of the following sensitive data categories defined under TDPSA: racial or ethnic origin, religious beliefs, mental or physical health diagnosis, sexual orientation, citizenship or immigration status, genetic or biometric data, precise geolocation, or personal data of children under 13.
How We Use Your Information
We use the information you provide to:
- Respond to inquiries and schedule on-site consultations.
- Provide design, installation, cleaning, maintenance, and repair services.
- Send project updates, invoices, scheduling notices, and follow-up communications related to active engagements.
- Improve our website, services, and customer experience based on aggregate website analytics.
- Comply with applicable laws, court orders, and regulatory requirements.
We do not use your personal information for "targeted advertising," "the sale of personal data," or "profiling in furtherance of decisions that produce legal or similarly significant effects" as those terms are defined under TDPSA.
How We Share Your Information
We do not sell, rent, or trade your personal information. We share information with trusted third parties only in these specific circumstances:
- Service providers — web hosting (the company that hosts aquanaturetexas.com), email service (the company that delivers our messages), payment processing (the company that processes invoices when you become a customer). Each of these providers is bound by contract to protect your data and use it only to provide the service we have engaged them for.
- Subcontractors — rare; only when a project requires specialty work outside our crew's scope (e.g., licensed electrician, structural engineer). We share only the minimum information required to complete the work.
- Legal compliance — when required by law, subpoena, court order, or government request.
- Safety — to protect the rights, property, or safety of AquaNature, our customers, or the public.
Your Texas Resident Rights (TDPSA)
If you are a Texas resident, you have the following rights regarding your personal information under TDPSA:
- Right to confirm and access — confirm whether we are processing your personal data, and obtain a copy.
- Right to correct — correct inaccuracies in your personal data, taking into account the nature of the data and the purposes of processing.
- Right to delete — request that we delete personal data you provided or that we obtained about you.
- Right to data portability — obtain a copy of your personal data in a portable, readable format where technically feasible.
- Right to opt out — opt out of any processing of your personal data for the purposes of targeted advertising, the sale of personal data, or profiling. We do not currently engage in any of these activities, but if that ever changes, we will provide a clear opt-out mechanism.
To exercise any of these rights, contact us using the information in the "Privacy Contact" section below. We will respond to verifiable requests within 45 days as required by TDPSA. If we need additional time (up to an additional 45 days), we will inform you of the extension and the reason. We will not discriminate against you for exercising any of these rights.
If we deny your request, you may appeal by replying to our denial. We will respond to appeals within 60 days. If we deny the appeal, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.
Cookies and Analytics
Our website uses the following cookies and analytics tools:
- Google Analytics 4 — sets cookies named
_gaand_ga_<property-id>to measure aggregate website traffic. Default retention is 24 months. We have IP anonymization enabled and have accepted Google's Data Processing Addendum. - WordPress session cookies — set only if you log in to a WordPress account on this site (typically only the site owner). Standard WordPress visitors do not receive these cookies.
- Cookie consent preferences — if a consent banner is present, your stated cookie preferences are stored in a small browser cookie so we don't ask again on every page load.

Data Retention
We retain personal information only for as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, and resolve disputes:
- Lead inquiries that do not become customers — up to 24 months from the last contact, then deleted.
- Active customer records — for the duration of the relationship plus 7 years after the final invoice (Texas statute of limitations on contract claims).
- Website analytics data — 24 months in Google Analytics, then automatically deleted.
- Email correspondence — up to 7 years from the date of last reply.
Data Security
We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, alteration, disclosure, or destruction. These include encrypted website connections (HTTPS), restricted access to customer records, and regular review of our hosting and email providers' security practices. However, no method of internet transmission or electronic storage is 100% secure, and we cannot guarantee absolute security.
Children's Privacy
Our website and services are directed to adults. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us using the information below and we will delete it promptly.
Out-of-State Visitors
If you are a resident of Louisiana, Oklahoma, or Arkansas, your state may not currently have a comprehensive privacy law analogous to Texas TDPSA. We extend the same access, correction, and deletion rights described in the "Texas Resident Rights" section to residents of all four states we serve.
Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Material changes will be posted on this page and, where appropriate, communicated to active customers by email. Continued use of our website or services after changes are posted constitutes acceptance of the updated policy.
